FREE TRANSFER OF FILMS - PRIVACY RELEASE

In my capacity as exclusive owner for the whole world of the filmed material relating to "VIDEO CONTEST DXT" lasting approximately 59 seconds,

 

HEREBY CEDES

1. exclusively to Atletica Zoldo ASD, via Roma 26, Val di Zoldo, BL, Italy (hereinafter “A.Z. ASD”), also pursuant to and for the purposes of the European Regulation on the protection of personal data 2016/679 ( “GDPR”) and the national privacy legislation in force, the right, but not the obligation, to use and allow the use of the videos through any type, manner, means and system of use - even with comical intent -, in any form, in whole or in part, even re-editing them, without limits of territory, time and passages.

The aforementioned rights start from the transfer of the Films to A.Z. ASD which will take place by sending via e-mail by 03/31/2024 and are granted to A.Z. ASD free of charge and irrevocably.

2. The undersigned guarantees that:

- he has not granted third parties rights that conflict and/or conflict with the aforementioned rights of A.Z. ASD;

- he has full title, legitimacy and all necessary releases signed by all interested parties to grant such rights, which has provided to interested parties appearing in the Material (the Videos), suitable information for the processing of personal data pursuant to the GDPR and who has acquired any authorization to disseminate the same, therefore, guarantees and releases A.Z. ASD from any liability, with reference to the correct collection of consent from interested parties, in relation to the processing of personal data whose legal basis is determined pursuant to art. 6, paragraph 1, letter. a) of the GDPR;

- he has paid compensation, expenses and charges of any kind to all those who appear in the Material or have participated in its creation;

- the Material does not contain elements of direct, indirect, subliminal advertising and nothing that violates laws, regulations or third party rights.

3. The undersigned will indemnify A.Z. ASD from any claim made regarding all of the foregoing and the uses that it will make of the Films in compliance with the above, indemnifying A.Z. ASD from any action or claim that may, in relation to this, be moved or advanced by third parties, including for the exercise of legal action where this constitutes a crime.

4. The undersigned declares to have read, understood and accepted the privacy information - DXT video contest” to which this Release is attached and which constitutes an integral part of the Release itself and acknowledges that, with the acceptance of this, the personal data will be provided to the Data Controller Atletica Zoldo ASD and will be processed by the Data Controller, with or without the aid of electronic instruments, for the following processing purposes: a) management and reproduction of images, films and/or voice through all the most suitable channels and means of communication with the right to process, reduce and/or adapt them; b) fulfillment of legal obligations; c) disputes and possible disputes. 

The legal basis of the processing of my data by the Data Controller is explicit consent, as well as - for the cases referred to in letters b) and c) - the related obligations and legitimate interest of the Data Controller. The data will be processed exclusively by authorized persons and possibly by external companies who will be designated by deed of appointment as data controllers. For further purposes, transmission may take place provided that my rights, interests or fundamental freedoms are not deemed to prevail. The data will be retained for the period necessary for the exploitation of the material transferred in accordance with the provisions of article 1) and may be processed for a further retention period in the cases referred to in letters b) and c). The undersigned is aware of having the right to revoke consent at any time and of the existence of further rights, and in particular: the right to access, rectification and cancellation, portability, limitation and opposition to treatment.
